Website Terms of Use

These terms at a glance

  • Everything on our site is free to access, and students don’t need an account.
  • Our Educational Resources are openly licensed under Creative Commons (CC BY-SA 4.0): the lesson plans, teacher guides, worksheets, presentation materials, instructional videos and teaching code examples we create, own and publish on our site. You can use, share and adapt them, even commercially, subject to the licence conditions set out below, including crediting us and sharing adaptations under the same licence.
  • The open licence does not cover everything, including some material inside an Educational Resource. Our brand, photos and recordings of identifiable people (other than our own presenters and narrators), third-party and partner material, the platform itself and our Lumen activities are excluded. AI-generated outputs are also excluded, unless the activity expressly says otherwise.
  • Don’t misuse the site — the usual rules apply.
  • If you hold a teacher or educator account, short Platform & Account Terms also apply.
  • These terms are governed by the laws of Victoria.

This summary is for convenience. The full terms below are what apply.

This website (Site) is operated by Tech Futures Australia Ltd (ABN 97 662 365 120) (we, our or us). It is available at techfutures.org.au and includes our online learning platform. Our AI learning environment, Lumen, is part of the same platform and is available at lumenlearn.ai. These Terms apply to your use of Lumen in the same way, and references in these Terms to our Site include Lumen at lumenlearn.ai. By using our Site you agree to these Website Terms of Use.

Agreement to these Terms

By accessing or using our Site, you agree to these Website Terms of Use (Terms). Our Privacy Policy, available at techfutures.org.au/privacy, explains how we handle personal information and does not form part of these Terms. Please read these Terms carefully. If you do not agree to them, please stop using our Site.

Changes to these Terms

We may update these Terms by publishing the updated version on our Site. Changes apply prospectively to your use of the Site after publication and do not affect rights or liabilities that arose earlier. If a change materially affects teacher or educator account holders, we will give notice in accordance with the Platform & Account Terms. We recommend checking back so you are aware of the current Terms. The materials and information on our Site (Content) may also change without notice. We do our best to keep the Site current, but Content may become inaccurate or out of date. The “Limitation of liability” section below explains the limits on our responsibility for the Content.

Using our Site

Our Site is free to access, and students do not need an account to use our learning content. We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable licence to access and use our Site in accordance with these Terms. This licence covers your use of the Site itself. Reuse of our Educational Resources is covered separately, and more generously, by the open licence described under “Our content and intellectual property” below.

If you hold a teacher or educator account

If you register for and hold a teacher or educator account on our Site, additional Platform & Account Terms apply to your account, together with these Website Terms of Use. You can read them at techfutures.org.au/platform-terms.

Acceptable use

You must not use our Site to do, or attempt to do, anything unlawful, anything prohibited by laws that apply to our Site, or anything that could damage our Site or harm other people, including:

  • breaching another person’s privacy or other legal rights;
  • defaming, harassing, threatening or menacing any person;
  • interfering with any other person’s use of our Site;
  • tampering with or modifying our Site, or transmitting viruses or other harmful code;
  • using our Site to send unsolicited messages;
  • otherwise misusing or interfering with our Site; or
  • helping anyone else do any of the above.

Our content and intellectual property

Unless otherwise indicated, we own or license all rights (including intellectual property rights) in our Site and its Content.

We want our educational materials to be used and shared widely. Educational Resources means the lesson plans, teacher guides, worksheets, presentation materials, instructional videos and teaching code examples that we create, own and publish on our Site. We make them available under the Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0) licence (creativecommons.org/licenses/by-sa/4.0). You are free to use, share and adapt them for any purpose, including commercially, provided you comply with that licence. In short, you must:

  • credit Tech Futures Australia in a reasonable manner;
  • keep any copyright, attribution, licence and disclaimer notices supplied with the resource;
  • link to the original resource where we have supplied a link and it is reasonably practicable;
  • indicate whether you made changes;
  • identify or link to the CC BY-SA 4.0 licence; and
  • license your adaptations under CC BY-SA 4.0, a later Creative Commons licence with the same elements, or a compatible BY-SA licence.

Ending your access to the Site does not withdraw a CC BY-SA 4.0 licence already granted over an Educational Resource. That licence continues on its own terms for as long as you meet its conditions.

What the open licence does not cover

The open licence applies only to Educational Resources. The following remain protected and may not be reused without our permission (or the relevant owner’s permission), including where they appear within or alongside an Educational Resource:

  • Children’s images, video and audio. Permission to use these has been given to Tech Futures Australia only. They must not be copied, saved, extracted, reproduced, republished or otherwise reused by anyone else. The consent behind them was given to us alone and is not ours to pass on.
  • Other identifiable people. Photographs, video or audio featuring identifiable people other than children, including teachers, staff, partners and event attendees, are not covered by the open licence. This does not apply to our own presenters and narrators appearing in an Educational Resource (such as an instructional video): they appear under consents that cover the open licence, so those resources remain covered.
  • Our brand. The Tech Futures Australia name, logo and brand assets are our trademarks and are not covered by the open licence.
  • Third-party and partner material. Material owned or contributed by a third party or partner is not covered by the open licence, whether or not it is marked or identifiable as theirs. It is not ours to license openly.
  • Lumen activities. The AI learning activities delivered through Lumen — including their prompts, activity designs, flows and configurations — are part of our platform, not Educational Resources, and are not covered by the open licence.
  • AI-generated outputs. We do not grant any licence in text, images or other material generated through our AI learning activities, unless the activity expressly says otherwise. They are not Educational Resources and are not covered by CC BY-SA 4.0. We also do not promise that copyright exists in an AI output or that it is free for you to use: your use of an output remains subject to applicable law, the activity instructions and any relevant provider terms.
  • The platform and software. The Site, the platform and the source code that runs them are not covered by the open licence. Teaching code examples we publish as Educational Resources are covered.

Before you reuse a whole resource

Photographs, illustrations, video, audio, logos and quoted text inside an Educational Resource are often owned by someone else, or fall within one of the exclusions above. Where they do, they are not covered by the open licence, whether or not they are marked. The licence covers the parts of the resource that we created and own, including its teaching text, structure, instructions and activities.

Before reusing a whole resource, inspect it for the excluded material above, and check any credits or source notes it carries. Remove or replace anything excluded. If you cannot tell whether particular material is covered, do not reuse that material under the open licence: treat it as excluded. You can also contact us at support@tfa.org.au.

Your use of our Site does not give you any rights in our Site or its Content beyond those set out in these Terms and the open licence that applies to our Educational Resources.

Information is general only

The Content is for general information and educational purposes only. It is not comprehensive, and it is not professional advice. It does not take into account your specific needs, objectives or circumstances. While we take reasonable care with the Content, to the maximum extent permitted by law we make no representation or warranty that it is complete, accurate or suitable for any particular purpose.

Third-party sites

Our Site may contain links to websites operated by others. Unless we say otherwise, we do not control, endorse or take responsibility for the content of those websites. You should make your own enquiries about whether they are suitable for you.

Availability of our Site

We may change, suspend or discontinue our Site, in whole or in part, at any time. We will try to give notice where it is practical to do so, but we may not always be able to. The “Limitation of liability” section below explains the limits on our responsibility if the Site changes, is suspended, becomes unavailable or is discontinued.

Disclaimers

To the maximum extent permitted by law, and subject to “Limitation of liability” below, we make no representations or warranties that our Site or Content: is complete, accurate, reliable, current or fit for any particular purpose; will be available without interruption or free of errors or viruses; or is secure. You use our Site and act on its Content at your own risk.

Outputs generated in our AI learning activities are machine-generated: they may be inaccurate, incomplete or inappropriate to your circumstances, and are not advice. Treat them as learning material to question and evaluate, not something to rely on.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss that was not reasonably foreseeable, arising from or in connection with your use of our Site or Content, any interruption or unavailability of our Site, or any loss or corruption of data. Nothing in these Terms limits liability that cannot lawfully be excluded — including for fraud or wilful misconduct — or excludes any rights or remedies you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

Indemnity

To the maximum extent permitted by law, you agree to compensate us for reasonably foreseeable loss, damage or expense we suffer to the extent it is directly caused by your material breach of these Terms or your unlawful use of our Site. This does not apply to loss to the extent we caused or contributed to it.

Ending or restricting access

These Terms apply while you use our Site. We may restrict or end your access to the Site if you seriously breach these Terms, or where we need to for legal or security reasons. Where practical, we will give reasonable notice.

Governing law

These Terms and your use of our Site are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that hear appeals from them.

If you access our Site from outside Australia

Our Site can be accessed in Australia and overseas. We make no representation that it complies with the laws of any country outside Australia. If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with your local laws.

Severance

If any provision of these Terms is found to be invalid or unenforceable, it will be read down as far as necessary to make it valid, or severed if it cannot be. The rest of the Terms continue to apply.
